1. In the name of God Amen
2. I Joseph Scammell of Noble Street in the parish of
3. Saint Ann Aldersgate Street London working Silversmith
4. being in good health and of sound and disposing mind
5. memory and understanding but considering the precariousness
6. of human Life do make publish and declare my last Will
7. and Testament in manner and form following that is to
8. say I do hereby give and bequeath unto Ann Simkins
9. widow the sister of my late wife Mary who now
10. resides with me the sum of one hundred pounds to said
11. for her own use and Benefit and I do hereby give and
12. bequeath unto my sister Elizabeth the wife of John Parfitt
13. the sum of ten pounds to and for her own sole and separate
14. use and Benefit and not to be subject to the Debts
15. Controul or Engagements of her present or any future
16. husband and I direct that her receipt above notwithstanding
17. her coverture shall be a sufficient discharge for the
18. same And I do hereby give and bequeath unto my friend
19. Thomas Swain of Lilyput Lane in the said parish of Saint
20. Ann Aldersgate Street London Engraver one of my executors
21. herein after named the sum of ten pounds for Mourning
22. And I do hereby give and bequeath unto my friend William
23. Bawtry of Lilyput Lane aforesaid Engraver the other of
24. my executors herein after named the sum of ten pounds
25. for Mourning As to all the rest residue and remainder
26. of my Estate and Effects of what nature and kind soever
27. and wheresoever which I may die possessed of or in any
28. manner entitled unto I do hereby give devise and bequeath
29. the same unto the said Thomas Swain and William Bawtry
30. upon the several trusts and to and for the several uses
31. Interests and purposes herinafter mentioned that is to say
32. In Trust from and immediately after my decease to sell
33. and dispose of all such Rest Residue and Remainder of
34. my Estate and Effects and convert the same into ready Money
35. and to lay out and invest all such sum and sums of
36. Money as shall arise therefrom upon Government
37. Securities at the discretion of my Executors herein after
38. named And in trust to pay all such sum and sums
39. of Money as arise or become due for the Interest
40. or Dividends of such Money so to be placed out at
41. Interest as aforesaid or so much thereof as my said
42. Executors shall think proper unto and for the Maintenance
43. Education and Promotion in the World of my two sons
44. Joseph and William Scammell until they shall arrive at
45. the age of twenty one years And I do hereby desire my
46. said Executors to advance and pay for each of my said
47. children at one apprentice fee any sum of Money they
48. think proper not exceeding Thirty pounds and I do hereby
49. empower my said Executors to sell or take out of the
50. Stocks or Principal sum of Money as much as will
51. enable them together with the Interest or Dividends in
52. their hands to make up and pay the said two apprentice
53. fees not exceeding Thirty pounds each and from and
54. immediately after my said children shall arrive to the
55. said age of Twenty one Years Then in Trust to pay
56. and divide all such Stock or Principal sum of Money
57. and all Interest then due theron unto and between my
58. said two children share and share alike it being my
59. Will and Mind that each of my said children shall
60. have his share immediately on his attaining the said
61. age of Twenty one Years and in case one of my said
62. children shall happen to depart this life before he shall
63. attain the said age of Twenty one Years without leaving
64. any Issue lawfully begotten Then In Trust to pay the
65. whole of such principal and interest unto my surviving
66. Son But in case my said Son so dying shall happen
67. to leave any Child or Children lawfully begotten
68. by him then I direst that the share of my said Son
69. so dying shall be paid to and equally divided among
70. all the children of my said son if more than one
71. And if but one then the whole to such only child
72. And in case both my said sons shall happen to
73. die before they attain the said age of Twenty one
74. Years without Issue Then In Trust from and immediately
75. after the death of both my said sons to pay all the
76. Money to arise or accrue from the Interest or Dividends
77. or Stock unto the said Ann Simkins during her life
78. if she shall so long remain a Widow and from and
79. immediately after the death of the said Ann Simkins or her
80. intermarriage Then In Trust to pay the sum of Two
81. hundred pounds part of the said Moiety or half part
82. unto William Simkins the son of the said Ann Simkins
83. to and for his own use and Benefit and upon Trust to
84. pay and divide all the Residue and Remainder of the
85. said Moiety or half part and all Interest or Dividends
86. to arise therefrom unto my nephews John Parfitt and
87. Joseph Parfitt in equal shares and proportions when they
88. shall arrive at their respective ages of Twenty one
89. Years And as to the other Moiety or half part of
90. the said principal sum or Stock In Trust to pay all
91. such sum and sums of Money as shall arise from the
92. Interest or Dividends thereof unto the said Elizabeth Parfitt
93. for and during the term of her Natural Life to and for
94. her own sole and separate use and Benefit and not
95. to be subject to the Debts Controul or Engagement of
96. her present or any future husband And I direct that
97. her Receipt alone notwithstanding the any coverture she
98. may be under shall from time to time be a sufficient
99. discharge for the same and from and immediately after
100. the death of the said Elizabeth Parfitt Then In Trust
101. then to pay and divide all the said other Moiety or half
102. part and all Interest and Dividends to arise therefrom
103. unto my Nephews John Parfitt and Joseph Parfitt
104. share and share alike when they shall arrive at
105. their respective ages of Twenty one Years and I do
106. hereby nominate constitute and appoint the said Thomas
107. Swain and William Bawtrey Executors of this my last
108. Will and Testament [ ] recommending to my said
109. Executors to consult with the said Ann Simkins in all
110. things affecting my said two sons and to permit
111. and suffer her to have the superintendence and care
112. of their Maintenance and Education until they shall
113. respectively be put out apprentices in case she shall so
114. long remain a Widow And my Will and Mind is and
115. I do hereby expressly declare that my said Executors
116. shall not be charged or chargeable with or accountable
117. for more of the aforesaid Monies or Effects than he
118. or they shall actually receive or shall come to his
119. or their hands by virtue of this my will nor with
120. or for any loss which may happen to the same
121. or any part thereof unless such loss shall happen
122. by or through their wilful neglect or default nor
123. the one of them for the other or for the Acts Deeds
124. Defaults or Disbursments of the other of them but
125. each one for his own Acts Deeds Defaults and
126. Disbursments only and also that it shall and may
127. be lawful for my said Executors and each of them
128. their and each of their Executors and Administrators
129. in the first place by and out of my Estate and
130. Effects to deduct and reimburse himself and themselves
131. all such loss costs charges and Expenses as he or
132. they shall or may sustain expend or be put for
133. or by reason of the performance of this my Will
134. or the Management and Execution thereof Lastly
135. I do hereby revoke and make void all former will
136. and Wills by me at any time made and do make
137. publish and declare this only to be and contain
138. my last Will and Testament contained in four
139. sheets of paper set my hand to the first second and
