1. In the name of God Amen 2. I Robert Mercer of the parish of Speldhurst in the County of Kent Yeoman 3. Do make publish and declare my last Will and Testament in the manner 4. following that is to say I direct that all my just debts funeral and testamentary 5. expenses and the charges of proving this my Will be duly paid and satisfied as 6. soon as convenient after my decease I give and devise all and every my messuages 7. lands tenements and hereditaments and parts or shares of messuages lands 8. tenements and hereditaments and all other my real Estates of what kind 9. or denomination the same may be unto my Wife Elizabeth Mercer to 10. hold the same and every part and parcel thereof with the rights members 11. privileges appendages and appurtenances there unto belonging unto my 12. said Wife Elizabeth Mercer and her assigns for and during the term if her 13. natural life to and for her own proper use and benefit and from and after 14. the decease I give and devise the same and every part and parcel 15. thereof unto and to the use and behoof of my sons and daughters Susan 16. Mercer Elizabeth Mercer Sarah the wife of Charles Cash Robert 17. Mercer John Mercer Mary Mercer and William Mercer and to their 18. respective heirs and assigns for ever as tenants in common and not as 19. joint tenants provided always and my will is that in case any or either 20. of my said sons and daughters shall depart this life without having 21. lawful issue of his or their body or bodies surviving then I do hereby 22. direct that the part or share of him or them so dying shall be 23. equally divided between the surviving brothers and sisters and to their 24. respective heirs and assigns for ever I give and bequeath all my personal 25. [ ] of every description unto my wife Elizabeth Mercer for the 26. term of her natural life and hour and after her decease the same to be 27. equally divided between my aforesaid children share and share alike 28. And lastly I do hereby nominate constitute and appoint my said Wife 29. Elizabeth Mercer and my son Robert Mercer Executrix and Executor 30. of this my will hereby revoking all other wills by me heretofore made 31. In witness where of I the said Robert Mercer the Testator have to this 32. paper set my hand and seal the sixteenth day of March in the year 33. of our Lord one thousand eight hundred and sixteen - The mark 34. and seal of X Robert Mercer - signed sealed published and 35. declared by the said Robert Mercer the testator as and for his last will 36. and testament the same having been first read over to him and he 37. having subscribed his mark 38. thereto in the presence of us who in his presence at his request and in 39. the presence of each other have hereunto subscribed our names as 40. witnesses Sarah Fry - The mark X of Sarah Fry - W Sprott Tu[nl] Wells |
